ARLINGTON, Texas — Darrell Roberson came home from a card game late one night to find his wife rolling around with another man in a pickup truck in the driveway.

Caught in the act with her lover, Tracy Denise Roberson — thinking quickly, if not clearly — cried rape, authorities say. Her husband pulled a gun and killed the other man with a shot to the head.

On Thursday, a grand jury handed up a manslaughter indictment — against the wife, not the husband.

In a case likely to reinforce the state's reputation for don't-mess-with-Texas justice, the grand jury declined to charge the husband with murder, the charge on which he was arrested by police.

"If I found somebody with my wife or with my kids in my house, there's no telling what I might do," said Juan Muniz, 33, who was having lunch Friday with one of his two small children at a restaurant in the middle-class suburban Dallas neighborhood where the Robersons lived. "I probably would have done the same thing."

Tracy Roberson, 35, could get two to 20 years in prison in the slaying of Devin LaSalle, a 32-year-old UPS employee.

Assistant District Attorney Sean Colston declined to comment on specifics of the case or the grand jury proceedings but said Texas law allows a defendant to claim justification if he has "a reasonable belief that his actions are necessary, even though what they believe at the time turns out not to be true."

Mark Osler, a Baylor University law school professor and a former federal prosecutor, said the grand jurors evidently put themselves in the husband's place: "I can see one of them saying, `I would have shot the guy, too. I was just protecting my wife.'"

The December night before the shooting, Tracy Roberson sent LaSalle a text message that read in part, "Hi friend, come see me please! I need to feel your warm embrace!" according to court papers. LaSalle apparently agreed.

Darrell Roberson, a 38-year-old employee of a real estate firm, discovered the two, his wife clad in a robe and underwear.

When Tracy Roberson cried that she was being raped, LaSalle tried to drive away and her husband drew the gun he happened to be carrying and fired several shots at the truck, authorities said.

Darrell Roberson's attorney did not immediately return a call for comment.

His wife also was charged with making a false report to a police officer — for allegedly saying she was raped — and could get up to six months behind bars on that offense. It was not immediately clear whether she had a lawyer.

She had not been arrested as of Friday afternoon.

They contain a misspelling.

The "West Virginia" printed on the shirts players wore after winning the NIT title with a 78-73 victory over Clemson on Thursday night is missing the last "i" in "Virginia."

WVU sports information director Shelly Poe said the NIT printed the shirts.

Calls to tournament officials were not immediately returned Friday.

West Virginia coach John Beilein also could not be reached for comment. He and the team were on their way back to West Virginia on Friday after winning their first NIT title in 65 years

May 1, 2007 -- FOXY Philadelphia TV reporter Alycia Lane is in hot water after a series of private e-mails and saucy snapshots she sent to handsome NFL Network anchorman Rich Eisen were intercepted by his wife.

Suzy Shuster, a sideline reporter for ABC's college football broadcasts, hit the roof when she discovered seven e-mails and several bikini photos sent by Lane - who works for CBS affiliate WKYW-TV and is recently divorced - to an account she and her husband, Eisen, share. That had Shuster firing off to Lane a scathing letter, a copy of which was obtained by Page Six.

A seething Shuster wrote: "Boy, do you look amazing in a bikini . . . congrats! Whatever you're doing, (Pilates? yoga?) keep doing it - it's working for you. Anyway, sorry but those seven e-mails you sent to my husband, Rich, well, oops, they came to the e-mail address we both use from time to time, but no worries, I'll forward the beach shots as well as the ones of you dancing with your friends on to his main address. Do you have it?"

She then provides her hubby's private e-mail, "since you surely are trying so hard to get his attention. I mean, what better way to get a guy's attention than with skin! Best - Suzy Shuster Eisen"

Brandrick was left with little more than the black suit, white shirt and red tie that he had planned to be buried in when it emerged a year later that his suspected "tumour" was no more than a non-life threatening inflammation of the pancreas. "When they tell you you've got a limited time and everything, you do enjoy life," Brandrick, from Cornwall in the west of England, told Sky television.

"I'm really pleased that I've got a second chance in life... but if you haven't got no money after all this, which is my fault -- I spent it all -- they should pay something back."

If he can't get compensation, he is considering selling his house or suing the hospital that diagnosed him. The hospital has said that while it sympathises with Brandrick, a review of his case showed no different diagnosis would have been made.

CAIRO, Egypt (AP) -- Customs officers at Cairo's airport have detained a man bound for Saudi Arabia who was trying to smuggle 700 live snakes on a plane, airport authorities said.

The officers were stunned when a passenger, identified as Yahia Rahim Tulba, told them his carryon bag contained live snakes after he was asked to open it.

Tulba opened his bag to show the snakes to the police and asked the officers, who held a safe distance, not to come close. Among the various snakes, hidden in small cloth sacks, were two poisonous cobras, authorities said.

The Egyptian said he had hoped to sell the snakes in Saudi Arabia. Police confiscated the snakes and turned Tulba over to the prosecutor's office, accusing him of violating export laws and endangering the lives of other passengers.

According to the customs officials, Tulba claimed the snakes are wanted by Saudis who display them in glass jars in shops, keep them as pets or sell them to research centers.

The value of the snakes was not immediately known.

Steven Cranley can't get a girlfriend -- at least for the next three years. That's the order of a judge in Ontario, who ruled that the 24-year-old Canadian has to remain single until 2010 as punishment for attacking his former girlfriend.

John Oakley of the National Post describes the "bold" order as "pre-emptive harm reduction."

WELLINGTON, New Zealand (AP) -- New Zealand authorities have blocked a couple's bid to officially name their new son "4real," saying numerals are not allowed.

Pat and Sheena Wheaton said they decided to name their new baby "4real" shortly after having an ultrasound and being struck by the reality of his impending arrival.

"For most of us, when we try to figure out what our names mean, we have to look it up in a babies book and ... there's no direct link between the meaning and the name," Pat Wheaton told TV One on Wednesday. "With this name, everyone knows what it means."

But when the parents filed the name with New Zealand's Registry of Births, Deaths and Marriages, they were told names beginning with a number were against the rules.

The government office has opened negotiations with the parents about the name under a policy that says all unusual names must be given case-by-case consideration.

"The name has not at this stage been rejected," Registrar-General Brian Clarke said in a statement Thursday. "We are currently in discussions with the parents ... to clarify the situation."

Clarke said the rules are designed to prevent names that are "likely to cause offense to a reasonable person." Satan and Adolf Hitler were proposed names that have been declined, he said.

If no compromise has been reached by July 9, the baby will be registered as "real," officials say.

New Zealand law requires all children born in the South Pacific nation to be registered with the Births, Deaths and Marriages registry within two months of birth.
